If you sustain an injury while visiting New York and we determine that pursuing a personal injury claim is the best course of action, as discussed in part 1 and part 2 of this series, we will begin working on your case immediately. Although it’s best to contact an attorney before you leave New York, we can take up the case after you’ve returned home and stay in touch with you via phone, email or WhatsApp.
Fortunately, many claims can be settled without requiring you to come back to New York to appear in court or for depositions or physical examinations. However, if the claim cannot readily be settled, we will prepare your case for court.
Going to court
A trial, whether it culminates in a verdict or elicits a favorable settlement offer, can result in significant compensation. This will depend on many factors unique to your case, which your attorney will carefully consider. Seitelman Law has successfully handled thousands of claims. We have in-depth knowledge of the complexities of personal injury law, and can generally anticipate likely outcomes and advise you on how best to proceed.
If you and your attorney decide to prepare for court, you can leave the work to us while you focus on recovering. We will file the necessary paperwork, manage discovery, arrange witnesses, advocate on your behalf with all involved parties, and prepare and deliver arguments in court. You can be assured that we will put our vast experience to work for you in order to win the most favorable verdict or settlement possible.
In the meantime, we are always available to you. We will communicate with you every step of the way.
How do court cases proceed? Can my case still settle?
The defense can offer a settlement at any point. In fact, settlement offers during the pre-litigation stage are very common. The stronger our preparation for trial, the more likely the defense will make an attractive settlement offer.
After the pre-litigation stage, if the parties have not agreed on a settlement, the trial will begin. It may last several days, during which our experienced litigators will present your case with the skill, energy, focus, and courtroom strategies that have led to countless highly favorable verdicts for our clients over the years.
As we pursue your claim, we will steer your case through the following steps:
- Filing the complaint and serving the defendant
- Managing the discovery phase by examining the defense’s evidence, managing the sharing of our evidence, taking official statements from witnesses, and preparing for trial
- Ensuring a fair, impartial jury by determining whether any potential jurors are biased against the case and rejecting them from selection
- Presenting the strongest possible advocacy on your behalf during mandatory conferences and settlement talks
Through the entire process, we will do the work for you, anticipating and managing all aspects, while keeping you informed on a consistent basis. Should any questions or concerns arise, we are always just a phone call away.
